The Appeals Process in Cincinnati

Those wishing to file a criminal appeal in Cincinnati—or anywhere in the state of Ohio—need to file a certain specific procedure.

While the specific circumstances surrounding your criminal case will have some effect on the process, in most case, the process is as follows:

  • First, your attorney will file a brief on your behalf
  • Next, the prosecutor will respond by filing their own brief
  • Then, a panel of three judges will hear both briefs
  • This panel will also listen to oral arguments presented by both sides
  • Lastly, the panel will vote, with the decision ultimately residing on the majority vote

It is important to note that just because you/your attorney has filed for an appeal, you will not necessarily receive an automatic stay on your conviction/execution of judgment. You may need to apply for an appellate bond if you wish to avoid jail/prison time while waiting for a decision on your appeal.

Additionally, if you pled guilty, you may be able to withdraw your guilty plea (if you have not yet been convicted). You may also appeal your sentence if you pled guilty and have already been sentenced.
