The Consequences of Multiple DUI/OVI Convictions

Repeat DUI/OVI offenses can result in some serious penalties, which may continue to affect you for years after. Multiple DUI/OVIs are based on a “look back” period of 6 years, meaning that your offenses are considered repeated if they occur within six years of the previous offense. The consequences for repeated DUIs include depends on the number of prior convictions.

Second DUI/OVI Offense

  • Minimum 10 days in jail
  • Fines between $525 and $1,625
  • Driver’s license reinstatement fee of $475
  • 90 days vehicle immobilization
  • Court mandated treatment or education

Third DUI/OVI Offense

  • 30 days to 1 year in jail
  • Fines between $850 and $2,750
  • 2 to 10 years driver’s license suspension
  • Vehicle forfeiture
  • Court mandated treatment or education

Fourth DUI/OVI Offense

  • 60 days to 1 year in jail
  • Fines between $1,350 and $10,500
  • 2 to 10 years driver’s license suspension
  • Vehicle forfeiture
  • Court mandated treatment or education

Fifth DUI/OVI Offense

  • Minimum 120 days in jail
  • Possibly 60 days in prison, with the option to impose an additional 6 to 30 months

If you are convicted of a fourth DUI/OVI within 6 years, you will be charged with a felony offense. If you are charged with a fifth DUI/OVI in a 20 year period, you will be listed in the habitual offenders registry. The registry is a public record with an internet database that lists your name, date of birth, home address, and convictions. You will remain in the registry until you no longer have 5 previous convictions within the past 20 years.
