When the police seize your driver’s license after you have been arrested for OVI, they are placing you under what is called an Administrative License Suspension. An ALS is imposed for one year for refusing a breathalyzer or for three months for registering a BAC over .08.
An ALS is separate from any court-ordered suspension you may receive, and remains in effect even if you are ultimately acquitted of the OVI charge. After the police seize your license, it is forwarded to the BMV and shredded. After your suspension is completed, you are required to obtain a new driver’s license from the BMV.
