A father’s custody rights were once guaranteed in America. Until the 19th century, children were considered paternal property. In the most recent century, the pendulum shifted and mothers were given custody almost automatically, presumably because of the nurturing bond between moms and kids. Ohio law (Revised Code 3109.03) says fathers and mothers “stand upon … equality as to the parental rights and responsibilities for the care of their children and the place of residence and legal custodian of their children, as far as parenthood is involved.” That means, in the eyes of the law, judges cannot consider gender alone when deciding who is a more suitable parent. This is true in most states.
